Mediation

Mediation is a confidential and consensual dispute resolution process in which an independent and impartial mediator facilitates the process between the parties to assist them to resolve their dispute and achieve a resolution that meets all parties' needs.

The mediator is not a decision-maker, and the process is based on achieving co creation and co-operation between the parties. The mediator assists the parties to make their own decisions and agreements. The mediator's role is to guide the process so that the issues can be defined, the relevant information produced and options explored without undue delay or legalistic procedures.

When a dispute is resolved in mediation, a written agreement which sets out the outcomes of the issues that have been resolved in the mediation is signed by the parties. 

Colin will facilitate appropriate processes to help the parties in mediation reach agreements with the best outcome for all parties concerned.

  • Colin is well able to facilitate small and large groups, is experienced in handling high stress situations, and in forming a balanced working alliance with both parties.
  • Colin has a strong calm presence and clear use of his authority to bring order to the mediation sessions.
  • Colin will assist individuals and the parties by working with their role systems (patterns of interactive responses), developing these so a resolution can be produced.  
  • Colin works strongly to capture the participant’s best intention for their own lives.
  • Colin will assess previous attempts to complete the dispute, identifying what stopped these from being successful. 
  • Colin will facilitate a contract to mediate, then facilitate the mediation to achieve an agreement  that will fully serve all parties involved.
  • Colin is  a very skilled listener, inviter of information and co-creator of  cooperative  relationships.
  • Colin will assess the set of behaviours and responses in order to produce conformity and productivity and then move the participants on to a collective set of progressive self-initiated responses.

In mediation settling the agreement or conflict belongs with the parties involved, Colin’s task is to facilitate the process and manage the relationships leaving parties to achieve their desired resolution.
